We also collect information about the transactions you undertake in the Cruz-Diez Foundation online gift shop and as a donor, including details of the payment cards used. Returns & Refunds

The Cruz-Diez Foundation would like you to be totally satisfied with your purchase. If for any reason you are not entirely happy with your order, please return to the address below within 30 days of receiving the item. A refund for the goods will be supplied, excluding any shipping costs, within 30 days from receipt of the returned goods without any additional fees at your charge except the direct cost of returning the goods.Please pack the items securely and return with a copy of the original invoice. Credit cannot be given for returned goods which are damaged in transit. For the return of high value goods, we recommend that you use a recorded delivery service.In the unlikely event that you receive goods which are not what you ordered or which are damaged or are of a different quantity to that stated on your order form, please contact the Cruz-Diez Foundation.

Gift Orders

If you would like to order something to be sent to a different name and address from your billing one, please input the beneficiary contact information in your account.


Product Availability

If the Cruz-Diez Foundation has insufficient stock to deliver the goods you have ordered, we will inform you by e-mail at the address given in your order, to advise you of a new availability date or to offer a full refund. These will be credited to your account within 30 days of the date of your order.



For individual customers, a 8.25% sales tax applies on orders delivered in Texas according to the Texas government policy.


Payment Options

You can pay with your Visa, Mastercard, American Express card or if you prefer through your Paypal account.  





Delivery Times

Items are usually dispatched within 4 working days after the order has been paid.

Our carrier aims to deliver within:

- 3 working days for France (depending on the hour of submission)

- 5 to 10 working days for other countries


Delivery Restrictions

We deliver anywhere in the world but our policy is not to deliver to PO Box addresses, due to courier restrictions.

Who are we?

The Cruz-Diez Foundation is a 501 c.3 non-profit organization. All our profits go to fund the work and activities we develop, so, every order supports the Cruz-Diez Foundation.

The Foundation is registered in Houston, Texas, USA,under the tax identification number 20-4405884. The headquarters of the foundation are in c/o The Museum of Fine Arts, Houston - P. O. Box 6826 - Texas 77265-6826 - USA. 

The terms and conditions listed below will apply between you and the Cruz-Diez Foundation for the sale and purchase of the items contained in your cart. The terms do not affect your statutory rights.



By ordering a product you accept these terms and conditions. They  are subject to updates at any time, and it is your responsibility to check for changes regularly before ordering.


Your undertakings and warranties

You warrant that the information given on your order form and personal information is complete and accurate.


Acknowledgement of Order

When you have completed your order you will be sent an e-mail confirmation. It will state what the products are on order, the total cost including sales tax (where appropriate) and delivery fees, together with shipment and invoice details. If for any reason your order cannot be processed, a member of the customer service team will contact you to explain the nature of the difficulty.


Availability of goods and prices

Goods will be sent to the address given when creating your account and providing your personal information and stated in the purchase confirmation mail. International Shipping If your delivery address is not in France, you may be subject to import duties and taxes, which are levied once a shipment reaches your country. Any such additional charges for customs clearance must be borne by you. You should note that customs policies vary widely from country to country; the Cruz-Diez Foundation refers each customer to contact their local customs office for further information.

Please be aware that cross-border shipments are subject to opening and inspection by customs authorities.


Data Protection

All credit and charge card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment, your order will not be accepted and the Cruz-Diez Foundation will not be liable for any delay or non-delivery.



Your statutory rights as a consumer are not affected if, for any reason, you wish to return a product bought from The Cruz-Diez Foundation online shop.


Damaged goods or incorrect deliveries

Any claim by you in respect of shortages and/or defects in the goods must be notified us within 7 days of the delivery date, stating the nature of the shortage/defect and quoting the invoice no.; failure to so notify us will deem you to have accepted the goods. In some cases the Cruz-Diez Foundation may require you to return the defective goods to the foundation at its cost. Where you make a valid claim in respect of shortages or defects and we are liable for the claim, we can at our option make up the shortages or replace the goods free of charge, or refund the price of the goods in question to you. In addition, for defective goods we will refund you reasonable costs incurred for postage of the goods, but we shall have no further liability to you. If you do not notify the Cruz-Diez Foundation accordingly, the Cruz-Diez Foundation shall have no liability for any defects and you shall be bound to pay for the goods.


Force Majeure

The Cruz-Diez Foundation shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.


Limitation of Liability

Although we take every care to ensure accuracy, we make no warranties as to the accuracy of the information we place on our web pages. The extent of our liability for any breach of these terms and conditions shall be limited to the value of the goods you ordered in the relevant transaction.


Invalidity of Terms and Conditions

If for any reason, part of these terms and conditions is unenforceable; the validity of the remaining terms and conditions shall not be affected.


Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with U.S. Law and agree to submit to the exclusive jurisdiction of the Texas courts.
